General terms and conditions of AMATSUNAWA GmbH

1. Scope
These general terms and conditions apply to all deliveries by AMATSUNAWA GmbH (hereinafter AMATSUNAWA) to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession.


2. Contracting party
The purchase contract is concluded with AMATSUNAWA GmbH, Owner: Michaela Hofmann, Reitenberger Weg 37, 93444 Bad Kötzting, registered with the Commercial Register of the Local Court of Regensburg, HRB 18762.


3. Conclusion of contract
The product presentations in the online shop do not constitute a legally binding offer but an invitation to place an order.
By clicking the button “Submit order” you submit a binding order for the goods listed on the order page. Your purchase contract is formed when we accept your order by sending an order confirmation by e-mail immediately after receipt of your order.



4. Right of Withdrawal (Consumers)
If you are a consumer (i.e. a natural person who places an order for purposes that are outside your trade, business or profession), you have a statutory right of withdrawal in accordance with the applicable legal provisions.
If, as a consumer, you exercise your right of withdrawal under section 4.1, you shall bear the regular cost of returning the goods.
Apart from that, the right of withdrawal is governed by the provisions set below in the 

Withdrawal Policy¹

4.1 Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us, AMATSUNAWA GmbH, Reitenberger Weg 37, 93444 Bad Kötzting, phone: +49 9941 93 49 893, email: info@amatsunawa.com, by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contact. You may use the attached model withdrawal form, which is not mandatory. You may also fill in and submit the model withdrawal form or any other clear statement electronically on our website (www.amatsunawa.com). If you use this option, we will send you without delay (e.g. by email) an acknowledgment of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract to:

The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

4.2 Return Costs for Cross‑Border Returns & Set‑Off upon Refund

  1. Refund upon withdrawal
    In the event of a valid withdrawal, we will refund all payments received from you for the withdrawn goods, including delivery costs for the outbound shipment in the amount of the least expensive standard delivery offered. Additional costs for a non‑standard delivery option chosen by you (e.g., express) will not be refunded. We may withhold the refund until we have received the goods back or you have provided proof of dispatch, whichever is earlier.
  2. Return costs for returns sent from abroad (consumers)
    If you have your residence outside Germany or return the goods from abroad, you shall bear the direct costs of returning the goods, provided there is no defect and unless we have expressly agreed otherwise.
    If we provide you, upon request, with a return label or organize a collection, the actual return shipping costs incurred will be deducted from the refund amount. The amount depends in particular on the country of dispatch, parcel weight/dimensions, and the carrier.
  3. Estimated maximum costs / bulky items (optional but recommended)
    For goods that cannot be shipped as a standard parcel (bulky items), return costs may be higher. Estimated maximum costs per shipment:
    - EU (excluding Germany): up to approx. €35
    - Switzerland/Liechtenstein: up to approx. €45 plus any customs clearance fees
    - United Kingdom: see shipping cost table plus any customs clearance fees
    - Other non‑EU countries: see shipping cost table plus any customs clearance fees
    Actual costs may vary depending on weight, volume, and pick‑up location.
  4. Customs, taxes and charges for returns from non‑EU countries
    For returns from non‑EU countries, you are obliged to declare the shipment as “returned goods”. Any customs duties, import VAT, clearance or delivery charges arising due to incorrect or omitted declaration, or resulting from shipping methods arranged by you, may be deducted from the refund to the extent permitted by law.
  5. No cost burden in case of defects / wrong items
    The above provisions on the allocation of return costs do not apply if the return is due to a defect in the goods, transport damage or wrong delivery. In such cases, we will bear the return costs or provide an appropriate free return label.
  6. Partial withdrawal
    If you withdraw only part of your order, we will refund the outbound delivery costs pro rata according to the value of the withdrawn goods. You shall bear the return costs also in the case of a partial withdrawal, insofar as Section 4.2(2) applies.
  7. Business customers 
    The statutory right of withdrawal does not apply to business customers within the meaning of Section 14 of the German Civil Code (BGB). Returns will only be accepted by prior arrangement; return costs and risk of loss are borne by the customer unless otherwise agreed in writing.


4.3 Undeliverable Shipments / Failure to Collect (No Withdrawal)

If a shipment is returned to us for reasons attributable to the customer (e.g., incorrect or incomplete delivery address, customer not available, failure to collect the parcel from the pick‑up location within the holding period, or unjustified refusal of acceptance), the customer shall bear:

  • the costs of the return charged by the carrier, and
  • the costs of a new delivery.

We may deduct these costs from any refund due or invoice them separately.
Such a case does not constitute a withdrawal within the meaning of the statutory right of withdrawal.


5. Prices and shipping costs
The prices stated on the product pages include the statutory value added tax and other price components. The shipping costs are clearly communicated to you on the product pages or in the shopping cart system and on the order page. The shipping costs for destinations outside of Germany vary from country to country and are clearly communicated to you on the product pages, in the shopping cart system and on the order page. Additional import fees, custom fees, custom handling charges may apply for international orders outside the EU. We are not liable for these costs. Please check before ordering with your local customs office.


6. Delivery
The delivery takes place within and outside of Germany with Deutsche Post, DHL, DPD or UPS. The delivery time is up to 3 days. We point out any deviating delivery times on the respective product page.


7. Note on the German packaging law
We are registered as a manufacturer with the German packaging register LUCID under number DE3063843420774. We have joined a corresponding system for the purpose of taking back and disposing of packaging waste. Further information can also be found at https://www.verpackungsgesetz.com .


8. Note on disposal of packaging
Please do not dispose of packaging waste with your household waste, but rather bring it to separate collection point. Well-known return options such as the yellow bag or the blue bin are available in your area (only valid for Germany!). You can also get more information about the correct disposal of packaging and the available return options for packaging waste from your city council or local authority.


9. Payment
Payment can be made either in advance via bank transfer, via credit card payment or via PayPal. If you choose the payment method in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.


10. Retention of title
The goods remain our property until they have been paid in full.


11. Dispute resolution
The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a point of contact for the out-of-court settlement of disputes regarding contractual obligations arising from online sales contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute settlement procedure before a consumer arbitration board.


Language clause: This English version is provided for convenience only. In the event of any conflict or inconsistency, the German version of these Terms and Conditions shall prevail.
